Elder Care

The California Department of Justice (DOJ) provides criminal history information to employers of persons who are non-licensed and providing non-medical domestic or personal care to an aged or disabled adult in the adult’s own home. This also includes applicants for In-Home Supportive Services (IHSS) or personal care services under Medi-Cal program administered by individual county agencies pursuant to Section 15660 of the Welfare and Institutions Code. Please note: Federal Bureau of Investigation background checks cannot be requested pursuant to this law.



As defined:



"Elder" means any person residing in this state, 65 years of age or older;


"Dependent Adult" means any person residing in this state between the Ages of 18 and 64, who has physical or mental limitations which restrict his or her ability to carry out normal activities or protect his or her own rights.
